In this charterparty dispute, the arbitral tribunal rejected the Owners’ claim for damages for breach of the safe port warranty in a time charterparty, after a laden bulk carrier grounded at the entrance to the port of Chaozhou, China, while under compulsory pilotage. It also held that the vessel was unseaworthy, in breach of Article III.1 of the Hague Rules, due to lack of proper charts, but found on the facts that this was not causative of the grounding.

This video shows an introduction on the Spiral-Test-Manoeuvre and describes the procedure how to steer through this manoeuvre and measure the data needed. The results will be displayed in a characteristic diagram allowing to identify stable and unstable conditions and related, detailed information, e.g. spiral loop width and height, rudder angle of neutral effect. Samples of stable and unstable ship behaviour demonstrations will be shown by Fast Time Simulation using the SAMMON Planning tool.

This is an exercise that is carried out at regular intervals by all crews on the Pilot boats and Tugs operating in Dublin Port, it is essential that crews are trained and ready to respond to any eventuality involving a MOB. In some instances it could be a casualty from another vessel. Container ship SHAHRAZ and bulk carrier SAMUDRA SAKTI I are reported to run aground in Singapore Strait south of St John Island at around 1900 UTC May 10, close to each other, while proceeding in the same direction, probably trying to avoid collision. As of 0700 UTC May 11, both ships remain in the same positions, coordinates don’t change. SHAHRAZ is en route from Port Klang to Yangshan China, SAMUDRA SAKTI I is en route from Belawan to Bayah, southwest Java.
